Eurosky Personal Data Server (PDS) – Terms of Service

1. Who we are
The Eurosky Personal Data Server ("PDS") is operated by Stichting Modal ("Modal", "we", "us"), a non-profit foundation established in the Netherlands.
Modal operates the Eurosky PDS in the public interest, under European Union law.
2. What the Eurosky PDS is
The Eurosky PDS is infrastructure for hosting an AT Protocol identity and storing and serving data associated with that identity. It enables use of compatible applications and services built on the AT Protocol.
The Eurosky PDS is not a social media platform. We do not operate feeds, recommend content, rank posts, or curate speech.
3. Acceptance and eligibility
By creating an account or using the Eurosky PDS, you agree to these Terms of Service and our Privacy Policy (together, the "Agreement").
You must be at least 16 years old, or the minimum age required to lawfully consent to personal data processing in your country, to use the service.
4. Your account, your data, your choices
You control your AT Protocol identity and decide which applications and services may connect to your PDS.
You retain any rights you have in the content and data you store on your PDS. Modal does not claim ownership of your content or social data.
Applications you choose to connect to your PDS are provided by third parties and are governed by their own terms and privacy policies. You are responsible for choosing providers you trust.
5. Acceptable use
You agree not to use the Eurosky PDS in ways that are unlawful or that materially interfere with the operation or security of the service, including by:
- storing, possessing, or distributing content where such storage, possession, or distribution is illegal under applicable law. This includes, but is not limited to:
- materials that constitute child sexually exploitative material (including material which may not be illegal child sexual abuse material but which nonetheless sexually exploits or promotes the sexual exploitation of minors), unlawful pornography, or are otherwise indecent;
- content that contains or promotes extreme acts of violence or terrorist activity, including terror or violent extremist propaganda;
- advocating bigotry, hatred, or the incitement of violence against any person or group of people based on their race, religion, ethnicity, national origin, sex, gender identity, sexual orientation, disability, impairment, or any other characteristic(s) associated with systemic discrimination or marginalization;
- violating the privacy or infringing the rights of others, including publishing, sharing, or storing other people's confidential information, identifying information, or intimate imagery without authorization for the purposes of harassing, exposing, harming, or exploiting them;
- attempting unauthorised access to accounts or systems;
- deploying malware or deliberately disrupting service availability;
- otherwise violating the law in any way, including storing, publishing, or sharing content which depicts, promotes, or instructs on illegal activity, is fraudulent, defamatory, misleading, or exploitative, or that infringes the intellectual property rights of others.
Modal aims to enforce policies fairly and consistently. Where we become aware of content that we are legally required not to store, we reserve the right to restrict access to or remove that content and take related account measures as required by law, up to and including removing user access to the PDS and suspending or terminating accounts.
6. Hosting and service infrastructure
Your Eurosky PDS account and associated identity data are hosted exclusively on cloud infrastructure located within the European Union. The PDS itself will not be hosted outside the EU.
To operate the service, we may also use third-party tools and service providers (for example for email delivery, forms, analytics, or operational communications). Some of these ancillary services may be hosted outside the European Union.
Where personal data is processed using such services, this is done in accordance with applicable EU data protection law and subject to appropriate safeguards, as described in our Privacy Policy.
7. Privacy and data protection
We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable EU and Dutch law.
Our Privacy Policy explains: what personal data we process; for what purposes; where it is processed; how long it is retained; and what rights you have.
This section should be read together with the Privacy Policy.
8. Legal compliance and restricted content
We do not proactively monitor all content stored or served through the PDS.
However, we will take proportionate measures where necessary to:
- comply with applicable law;
- respond to valid orders from competent EU authorities;
- protect the security and integrity of the service; or
- address clearly unlawful content where we are legally required to act.
Measures may include restricting access to specific data or suspending or terminating accounts, where required by law or necessary to prevent harm.
We may rely on interoperable and modular compliance or moderation services to help meet legal obligations, without centralising control over speech.

9. Availability and changes
We aim to operate a reliable service; however the Eurosky PDS is provided on a best-efforts basis. Planned maintenance, upgrades, or security work may result in temporary downtime.
We may update these Terms from time to time to reflect changes in the service, the law, or our operations. If a change materially affects users, we will take reasonable steps to notify you in advance and indicate when the updated Terms take effect.
Terms will be published together with notification of the most recent update.
10. Termination and portability
You may stop using the Eurosky PDS at any time.
Where supported by the AT Protocol and available tooling, you may migrate your identity and data to another compatible provider.
We may suspend or terminate access if:
- you materially breach these Terms;
- continued provision of the service would violate applicable law; or
- suspension is necessary to protect the security or stability of the service.
Where reasonable and lawful, we will provide notice and an opportunity to address the issue before termination.
11. Security
You are agreeing that the security of your account and password are your responsibility. Through the use of our Service(s) Modal is not responsible or liable for any damages you may suffer by the compromise of your account.
If you feel your account may have been compromised, you agree to notify support immediately so proper action can be taken.
In the event of your account being compromised, you agree that you may have: restricted, limited, or no access to your account during the ongoing investigation of the fraudulent activity.
12. Liability
Nothing in these Terms limits or excludes liability where such limitation is not permitted by applicable law.
To the extent permitted by law, Modal is not liable for indirect or consequential losses arising from use of the Eurosky PDS.
Modal's total liability for direct damages arising out of or in connection with the service is limited to the amount you paid for the service in the 12 months preceding the event giving rise to the claim, or EUR 100 if you paid nothing, unless mandatory law requires otherwise.
You agree to defend, indemnify and hold no liability to: Modal, its employees, directors, agents, officers, contractors affiliates and associates from and against any and all claims of: damages, losses, associated costs or debts, expenses, obligations, and attorney's fees from your use and access of Modal Service(s) or your violation of any of the Terms or Clauses listed in this Agreement.
13. Consumer rights
If you are a consumer in the European Union, you may have mandatory rights under EU or national consumer protection law. Nothing in these Terms is intended to limit those rights.
14. Severability
In the case that any court with ruling jurisdiction over these Terms of Service finds any Term or Clause unenforceable, then you and Modal, agree that the remaining Terms and Provisions in the Terms of Service will still be in effect; unless the unenforceable Term or Provision is the fundamental source behind the Terms of Service; then the Terms of Service will be terminated. If provisions of the Terms of Service contradict, Modal will decide which of these Provisions or Terms will be enforced, and will discard the other.
15. Agreement Assignment
Under no circumstances are you allowed to assign your rights or obligations under this Contract to any other: person, organization, or party, without the prior written consent of Modal. You agree to and confirm that we have the right to assign our rights and/or obligations under this Contract to any other: person, organization, or party at our discretion; at any time and/or date, for any reason.
16. Duration of terms
The Terms of Service will continue to bind you for as long as you use any or all of the following: our PDS, Product(s), or Service(s); along with the cancellation or termination of your Eurosky account.
17. Governing law and jurisdiction
These Terms are governed by the laws of the Netherlands.
Any disputes will be submitted to the competent courts of the Netherlands, unless applicable law requires otherwise.

Eurosky Personal Data Server (PDS) – Privacy Notice

This Privacy Notice explains how personal data is processed when you use the Eurosky Personal Data Server (PDS). It applies specifically to the PDS and is separate from the Privacy Policy that applies to the Eurosky websites, mailing lists, and general communications.
1. Who we are
The Eurosky PDS is operated by Stichting Modal ("Modal", "we", "us"), a non-profit foundation established in the Netherlands.
For the purposes of the EU General Data Protection Regulation (GDPR), Stichting Modal is the data controller for personal data processed in connection with the operation of the Eurosky PDS.

2. What the Eurosky PDS is
The Eurosky PDS provides personal data storage and identity hosting services for the AT Protocol. It allows you to:
- create and manage an AT Protocol identity;
- store personal data and content associated with that identity; and
- connect your identity to compatible applications and services of your choosing.
The Eurosky PDS is infrastructure. We do not operate social media feeds, recommend content, or curate speech.
3. What personal data is processed via the PDS
Depending on how you use the service, we may process the following categories of personal data:
- account identifiers and handles;
- profile information you choose to provide;
- content you post, upload, or store via your PDS;
- social graph data (such as follows and connections);
- technical and operational data required to operate the PDS (for example, IP addresses, timestamps, and logs);
- security and abuse-prevention signals.
We do not intentionally process special category (sensitive) personal data.
4. Why we process PDS data
We process personal data via the PDS in order to:
- provide and operate identity hosting and personal data storage services;
- enable interoperability with AT Protocol applications chosen by you;
- maintain the security, stability, and integrity of the service;
- detect and prevent abuse or misuse of the PDS; and
- comply with applicable legal obligations.
5. Legal bases for processing
Under the EU GDPR, we rely on the following legal bases when processing PDS data:
- Performance of a contract – to provide the PDS services to you;
- Legitimate interests – to operate, secure, and improve the PDS, and to prevent abuse, where those interests are not overridden by your fundamental rights and freedoms;
- Legal obligation – where processing is required to comply with EU or national law.
6. Where PDS data is hosted and processed
Personal data stored on the Eurosky PDS is hosted on infrastructure located within the European Union.
To operate and secure the service, we may use service providers acting on our behalf as data processors (for example, for cloud infrastructure, monitoring, or security). Where such providers process personal data, they do so under contractual safeguards and in accordance with EU data protection law.
7. Sharing of PDS data
Your PDS data may be shared in the following circumstances:
- with applications and services you choose to connect to your PDS, in accordance with the AT Protocol;
- with infrastructure or security service providers acting as data processors on our behalf;
- with public authorities, where we are legally required to do so.
We do not sell PDS data.
8. International data transfers
We aim to host and process PDS data within the European Union.
Where limited personal data related to the operation or security of the service is processed outside the European Union (for example, by certain security or monitoring providers), appropriate safeguards are in place in accordance with EU data protection law, including Standard Contractual Clauses approved by the European Commission.
9. Data retention
We retain PDS data for as long as your account is active.
If you delete your account or migrate your identity to another compatible provider, we will handle your data in accordance with the AT Protocol and applicable law. Certain limited data may be retained where required for legal, security, or operational purposes.
10. Your rights
You have the right to:
- access your personal data;
- correct inaccurate or incomplete data;
- request deletion of your data;
- restrict or object to certain processing;
- request data portability.

You also have the right to lodge a complaint with your local data protection authority.
11. Data security
We use appropriate technical and organisational measures to protect PDS data against unauthorised access, loss, or misuse.
12. Changes to this notice
We may update this Privacy Notice from time to time to reflect changes to the Eurosky PDS or to applicable law. The most recent version will always be published, with the date of the latest update indicated above.
