Eurosky PDS and Portal – Terms of Service

1. Who we are

The Eurosky Personal Data Server ("PDS") and the Eurosky Portal ("Portal") are operated by Stichting Modal ("Modal", "we", "us"), a non-profit foundation established in the Netherlands.

Modal operates the Eurosky PDS and the Eurosky Portal in the public interest, under European Union law.

2. What the Eurosky PDS and Portal are

The Eurosky PDS is infrastructure for hosting an AT Protocol identity and storing and serving data associated with that identity. It enables use of compatible applications and services built on the AT Protocol. The Eurosky PDS is not a social media platform. It does not provide feeds, recommend content, rank posts, or curate speech.

The Eurosky Portal is a user-facing front-end available at portal.eurosky.tech. The Portal is currently available only to users of the Eurosky PDS; this restriction may be relaxed in future versions. The Portal allows Eurosky PDS users to:

  • create a Eurosky account on the Eurosky PDS;
  • sign in to their account using AT Protocol OAuth;
  • view a dashboard with their profile information as fetched from their PDS;
  • browse and view data stored in their PDS, such as images, videos, and other media;
  • discover compatible third-party AT Protocol applications via a featured-apps directory;
  • use sign-in facilitation for selected third-party apps, where the Portal shares your handle with the app to streamline its sign-in flow; and
  • access account management and support links.

The Portal is currently in beta. This means it is an early version that is not feature-complete, and its features and behaviour may change.

The Portal is not an online platform: it does not host user content, operate feeds, recommend content, or curate speech.

The Eurosky migration tool EU-HAUL is a separate product with its own Terms of Service and Privacy Policy. These Terms do not apply to EU-HAUL.

3. Acceptance and eligibility

By creating an account, using the Eurosky PDS, or using the Eurosky Portal, you agree to these Terms of Service and our Privacy Notice (together, the "Agreement").

You must be the minimum age required to lawfully consent to personal data processing in your legal jurisdiction to use this service. In Europe under the GDPR, the default age is 16.

4. Your account, your data, your choices

You control your AT Protocol identity and decide which applications and services may connect to your PDS.

The Portal is not a separate account. When you sign in to the Portal, you are signing in with your Eurosky PDS account via AT Protocol OAuth. Your Portal session is tied to your PDS identity.

You retain any rights you have in the content and data you store on your PDS. Modal does not claim ownership of your content or social data.

Applications you choose to connect to your PDS, or that you access through the Portal's app directory, are provided by third parties and are governed by their own terms and privacy policies. You are responsible for choosing providers you trust.

5. Acceptable use

You agree not to use the Eurosky PDS or the Eurosky Portal in ways that are unlawful or that materially interfere with the operation or security of the service, including by:

  • storing, possessing, or distributing content where such storage, possession, or distribution is illegal under applicable law. This includes, but is not limited to:
    • materials that constitute child sexually exploitative material (including material which may not be illegal child sexual abuse material but which nonetheless sexually exploits or promotes the sexual exploitation of minors), unlawful pornography, or are otherwise indecent;
    • content that contains or promotes extreme acts of violence or terrorist activity, including terror or violent extremist propaganda;
    • advocating bigotry, hatred, or the incitement of violence against any person or group of people based on their race, religion, ethnicity, national origin, sex, gender identity, sexual orientation, disability, impairment, or any other characteristic(s) associated with systemic discrimination or marginalisation;
  • violating the privacy or infringing the rights of others, including publishing, sharing, or storing other people's confidential information, identifying information, or intimate imagery without authorisation for the purposes of harassing, exposing, harming, or exploiting them;
  • attempting unauthorised access to accounts or systems;
  • deploying malware or deliberately disrupting service availability;
  • otherwise violating the law in any way, including storing, publishing, or sharing content which depicts, promotes, or instructs on illegal activity, is fraudulent, defamatory, misleading, or exploitative, or that infringes the intellectual property rights of others.

Modal aims to enforce policies fairly and consistently. Where we become aware of content that we are legally required not to store, we reserve the right to restrict access to or remove that content and take related account measures as required by law, up to and including removing user access to the PDS and Portal, and suspending or terminating accounts.

6. Hosting and service infrastructure

Your Eurosky PDS account and associated identity data are hosted exclusively on cloud infrastructure provided by an EU-headquartered hosting provider, in data centres located within the European Union. At the time of writing, that provider is Hetzner Online GmbH (Germany). We may change our infrastructure provider from time to time, but we are committed to using only providers that are headquartered in the EU and that process personal data exclusively in data centres within the European Union. The PDS and Portal themselves will not be hosted outside the EU.

To operate the service, we may also use third-party tools and service providers (for example, for email delivery, forms, analytics, or operational communications). Some of these ancillary services may be hosted outside the European Union. Where personal data is processed using such services, this is done in accordance with applicable EU data protection law and subject to appropriate safeguards, as described in our Privacy Notice.

7. Privacy and data protection

We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable EU and Dutch law.

This section should be read together with the Privacy Notice.

8. The Portal — features and third-party apps

Featured-apps directory. The Portal includes a directory of third-party AT Protocol applications. Clicking a plain featured app opens the third-party application's website in a new browser tab. The Portal does not transmit your personal data to these applications.

Sign-in facilitation. For selected third-party apps, the Portal may facilitate the sign-in process by sharing your handle with the destination app so that it can identify you and streamline its own sign-in flow. Before any data is shared, the Portal will clearly inform you of what will be transmitted. Only your handle (and, where applicable, a marker identifying Eurosky as the referring service) is shared. The Portal does not share your OAuth access token, your email address, your password, or any other profile or account data with third-party apps through this feature.

Data browsing. The Portal may allow you to browse and view data stored in your PDS, such as images, videos, and other media. This data is retrieved from your PDS using your existing authentication and displayed to you within the Portal for your own use. The Portal does not independently store copies of this data and does not share it with any third party.

Third-party responsibility. Once you leave the Portal and visit a third-party application — whether via the featured-apps directory, sign-in facilitation, or any other link — that application is operated by a third party and is governed by its own terms and privacy policy. We are not responsible for the privacy practices or conduct of third-party applications.

Beta disclaimer. The Portal is currently in beta. Features may be added, changed, or removed as the Portal develops. We will take reasonable steps to notify users of material changes.

9. Legal compliance and restricted content

We do not proactively monitor all content stored or served through the PDS.

However, we will take proportionate measures where necessary to:

  • comply with applicable law;
  • respond to valid orders from competent EU authorities;
  • protect the security and integrity of the service; or
  • address clearly unlawful content where we are legally required to act.

Measures may include restricting access to specific data or suspending or terminating accounts, where required by law or necessary to prevent harm.

We may rely on interoperable and modular compliance or moderation services to help meet legal obligations, without centralising control over speech.

Notices relating to illegal content or legal orders may be submitted to notices@eurosky.tech.

10. Availability and changes

We aim to operate a reliable service; however, the Eurosky PDS and Portal are provided on a best-efforts basis. Planned maintenance, upgrades, or security work may result in temporary downtime.

We may update these Terms from time to time to reflect changes in the service, the law, or our operations. If a change materially affects users, we will take reasonable steps to notify you in advance and indicate when the updated Terms take effect.

Terms will be published together with notification of the most recent update.

11. Termination and portability

You may stop using the Eurosky PDS and Portal at any time.

Where supported by the AT Protocol and available tooling, you may migrate your identity and data to another compatible provider.

We may suspend or terminate access if:

  • you materially breach these Terms;
  • continued provision of the service would violate applicable law; or
  • suspension is necessary to protect the security or stability of the service.

Where reasonable and lawful, we will provide notice and an opportunity to address the issue before termination.

If your Eurosky PDS account is terminated, suspended, or migrated to another provider, your access to the Portal will also end, since the Portal requires an active Eurosky PDS account.

12. Security

You are responsible for keeping your account credentials secure. Modal is not liable for any loss or damage resulting from unauthorised access to your account where that access was caused by your failure to protect your credentials.

If you believe your account may have been compromised, please notify us promptly at support@eurosky.tech so that we can take appropriate action.

During an investigation into suspected unauthorised access, we may need to restrict or temporarily suspend access to your account in order to protect your data and the integrity of the service.

13. Liability

Nothing in these Terms limits or excludes liability where such limitation is not permitted by applicable law.

To the extent permitted by law, Modal is not liable for indirect or consequential losses arising from use of the Eurosky PDS or Portal.

Modal's total liability for direct damages arising out of or in connection with the service is limited to the amount you paid for the service in the 12 months preceding the event giving rise to the claim, or EUR 100 if you paid nothing, unless mandatory law requires otherwise.

You are responsible for your own use of the service and for any consequences of violating these Terms, to the extent permitted by applicable mandatory law.

14. Consumer rights

If you are a consumer in the European Union, you may have mandatory rights under EU or national consumer protection law. Nothing in these Terms is intended to limit those rights.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be severed and the remaining provisions will continue in full force and effect. Where a provision is severed, the parties will use reasonable efforts to agree on a replacement provision that reflects the original intent as closely as possible within the bounds of applicable law.

16. Assignment

You may not assign your rights or obligations under these Terms to another party without our prior written consent.

We may assign our rights and obligations under these Terms to a successor organisation or affiliate, provided that the assignee agrees to be bound by these Terms on the same conditions.

17. Duration of terms

These Terms apply for as long as you have an active Eurosky account or use any Eurosky service. Certain obligations (including those relating to liability, indemnity, and governing law) survive termination.

18. Governing law and jurisdiction

These Terms are governed by the laws of the Netherlands.

Any disputes will be submitted to the competent courts of the Netherlands, unless applicable law requires otherwise.
